Welcome to Smog AI. These Terms of Service ("Terms") govern your use of our AI-powered meeting assistant application and related services (collectively, the "Service"). By accessing or using Smog AI, you agree to be bound by these Terms.

All fees are non-refundable except as required by law
You authorize us to charge your payment method for renewal unless you cancel
Failed payments may result in service suspension or termination

4.3 Cancellation

You may cancel your subscription at any time from your account settings
Cancellation takes effect at the end of your current billing period
No refunds for partial months or unused features
You retain access to paid features until the end of your billing period

5. Usage Limits and Fair Use

Each subscription tier includes specific usage limits (e.g., number of AI queries, transcription hours). Excessive or abusive use that significantly exceeds normal patterns may result in service throttling or account suspension.

Fair Use Policy: Smog AI is designed for individual or team use. Automated scripts, bots, or reselling of our service is strictly prohibited.

6. Acceptable Use

You agree NOT to use Smog AI to:

Violate any laws, regulations, or third-party rights
Harass, abuse, or harm others
Distribute malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems
Reverse engineer, decompile, or disassemble our software
Scrape, copy, or reproduce our content without permission
Record or transcribe meetings without consent of all participants (where required by law)
Use the Service for illegal surveillance or unauthorized monitoring

7. Recording Consent and Legal Compliance

Important Legal Notice: You are solely responsible for complying with all applicable laws regarding recording, transcription, and monitoring of conversations.

Many jurisdictions require consent from all parties before recording
You must obtain necessary consents before using Smog AI in meetings
You are liable for any violations of recording consent laws
Smog AI is not responsible for your compliance with local laws

8. Intellectual Property

8.1 Our Rights

Smog AI and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of any content you create using Smog AI (transcripts, notes, etc.). By using our Service, you grant us a limited license to process your content solely to provide the Service.

9. AI-Generated Content

Smog AI uses artificial intelligence to provide transcriptions and responses. While we strive for accuracy:

AI responses may contain errors or inaccuracies
You should verify important information independently
We do not guarantee the accuracy, completeness, or reliability of AI-generated content
You are responsible for how you use AI-generated information

11. Disclaimers

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMOG AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
